Cyclist Killed in Accident With Semi: Family May Seek Lawsuit Funding?

This horrid accident happened in Maryland and resulted in a $5 million dollar wrongful death lawsuit being filed on behalf of 67-year old cyclist Jack Yates. Yates was riding his bike down an avenue when a big rig rear ended him. The force of the impact jammed the bike under the truck’s wheels. This in turn meant Yates was run over and killed as the truck turned a corner. The truck didn’t stop and left the scene of the fatal accident.

Despite a quick response from EMS crews, they could do nothing to revive Yates and he was pronounced dead at the scene. The police finally traced the truck down two days later at a trucking yard. The front tires had blood and hair on them that matched DNA for Jack Yates. The police believe the driver didn’t stop because he had no idea he’d hit the cyclist because the truck was enormous.

Yate’s family filed a wrongful death lawsuit, citing negligence against the trucker, Michael Dale Chandler and his employer. Evidently a surveillance video showed the trucker making a right turn without a turn signal. The law also requires cyclists to as far to the right as possible, with the flow of traffic. Yates was doing just that. Police said Yates was at fault for riding in a parking lane and trying to pass the truck on the right.
